Due to increased enforcement efforts by the DOL and state agencies, as well as an explosion of individual and class action litigation, employers are facing a wage and hour compliance challenge unlike any before.
Both the IRS and the Department of Labor have said that they will share information when investigating companies to ensure that their payroll practices and employee classifications are in compliance. On a local level, there has been increased attention paid to employers regarding misclassification of individuals as Independent Contractors.
