Dianne is a trial lawyer who joined SS+D’s Litigation Department in September 2005 and was named a shareholder in January 2008. Having participated in some 20 jury trials of civil matters in both federal and state courts, as well as representing clients in numerous court trials and hearings, Dianne loves the courtroom and has experience in the following areas:

  • Disputes involving wills and trusts on behalf of families and fiduciaries
  • Trade secret litigation and covenants not to compete
  • Fraudulent transfers and schemes to defraud investors
  • Insurance coverage disputes
  • Intentional tort and discrimination claims
  • Bond claims of sureties
  • Personal injury litigation and malpractice issues

Recently, following a four-week trial in Federal Court, Dianne, and one of her partners, Toby Henderson, obtained a jury verdict in excess of $6.9 million in favor of an Ohio-based diamond dealer and against an international, New York-based diamond manufacturer and distributor and one of the largest De Beers sightholders in the country.

With over 25 years of experience representing publicly-traded companies, as well as individuals and family-owned businesses, Dianne fights for her clients, yet also knows that due to the cost and emotional toll litigation can take, creative settlements through alternative dispute resolution and mediation can sometimes be best for her client. Consistent with this, Dianne has completed mediation training at the Strauss Institute for Dispute Resolution at Pepperdine University in California.

As Past President of the Dayton Bar Association and Dayton Bar Foundation, Dianne is actively involved in the legal community and other lawyers frequently refer cases to her for litigation purposes. Dianne’s philosophy on referrals is simple and is based in part on her own experience in running a small law firm – once the litigation is completed, the client is referred back to the referring lawyer and the representation ends. Because of her broad legal experience and past representation of beneficiaries and fiduciaries in state and probate courts, Dianne chairs the Probate Litigation Practice Group at SS+D.

Dianne received her undergraduate degree, magna cum laude, from Miami University in Oxford, Ohio, in 1979, graduating Phi Beta Kappa, and her J.D. in 1982 from the University of Notre Dame School of Law, where she was a Thomas J. and Alberta White Scholar on Law and Public Policy. She is admitted to practice before all state courts in Ohio, as well as the U.S. District Court for the Southern District of Ohio and the U.S. Court of Appeals for the Sixth Circuit.

In addition to being a member of the Dayton and Butler County Bar Associations, Dianne is a member of the Ohio State Bar Association (Probate and Litigation Sections), American Bar Association, Litigation Section and Tort Trial and Insurance Practice Section; American Bar Association Foundation; and Ohio Association of Civil Trial Attorneys, and serves as a volunteer mediator for both state and federal courts. Dianne is also involved in the following community activities:

  • Greater Dayton Volunteer Lawyers Project, Board of Trustees
  • A Special Wish Foundation Advisory Board, Children’s Medical Center

Prior to joining SS+D, Dianne spent 17 years as one of two partners in private practice with the firm of Rieser & Marx. The firm and its staff of associates and paralegals focused on general civil and bankruptcy litigation. She also spent two years in the Dayton office of a large international law firm.
