For nearly two decades, SS+D has lead the nationwide defense of clients sued for toxic torts in more than 40,000 cases across the county. By tapping into the extensive resources of SS+D’s litigation practice and leveraging our broad experience gained from handling these complex tort cases, we are able to defend and resolve these challenging cases.

This dynamic and expanding area of litigation includes the pursuit by plaintiffs of damages allegedly caused by toxic substances. These cases include claims ranging from product liability, willful indifference and specific intent, breach of implied and express warranties, and failure to warn. Damages sought in toxic tort cases include those for personal injuries (including death), future longstanding illnesses, and damages to real property.

Wherever a client may be sued, we have the experience and depth to coordinate discovery, identify and retain the right scientific experts, prepare and defend corporate witnesses for depositions and trial, provide a single point of contact for case handling, and participate in trials. We understand well the interplay between toxic tort claims against our clients and insurance policies issued in some instances more than fifty years ago. Our role in managing the defense of our clients includes ensuring insurance companies honor their obligations to assist in that defense.
